When did the law take
effect? The training requirement is
new law that became effective February 14, 2003.
Who must get trained? All
Permittees (i.e. tank owners) must designate one person as the
Operator. The Operator is the one who must get trained.
Is there a deadline? Yes.
All Operators in 2003 must have been
trained by March 1, 2004.
What about new operators after March 1, 2004? After the deadline, a
new designated UST Operator has 90 days to get
trained.
What must be learned?
Operators must learn about all technical rules on leak
prevention plus all UST administrative laws. It's
basically all of Oregon's tank rules (OAR 340-150-0001-
0620.)
How often is training
required? Training is a one-time
requirement. However, if your designated operators leaves,
the owner has 90 days to get the new operator trained.

Can a designated
Operator be responsible for more than one facility? Yes.
An Operator can be represent more than one facility; but
check with DEQ
to determine what is a reasonable maximum.
Are there trainer
credentials? Yes. Operators must be trained
by a vendor listed by Oregon DEQ. Ben Thomas Associates is

Must there be proof of
receiving training? Yes. Operators must prove to DEQ they
are trained by March 1, 2004.
What happens if there
is no trained Operator for a UST facility? Failure to
have a trained, designated Operator by
deadline can result in enforcement action by DEQ including
a field citation (i.e. a fine).
Must gas station
attendants have to be trained too? Yes. The new law
requires that tank owners must provide basic spill
response information to all attendants through training or
posting the information on-site.
